These Terms govern use of OmegaWebPro.com and the Omega Web Pro service, including Builder, website generation, the NZ$999 Lifetime Single Website Domain Licence, customer accounts, protected ZIP exports, Pure HTML and WordPress output, and lifetime same-domain re-editing.

Terms for website access, purchasing, licensing and use.
These Terms govern your relationship with Alpha & Omega Limited when accessing Omega Web Pro and purchasing or using an Omega Web Pro Lifetime Single Website Domain Licence.
1. Acceptance of these Terms
Omega Web Pro is operated by Alpha & Omega Limited. References in these Terms to “Omega”, “Omega Web Pro”, “we”, “us” or “our” refer to Alpha & Omega Limited where the context requires.
By accessing or using OmegaWebPro.com, Builder or another public part of the service, you agree to the provisions of these Terms that apply to website access and use.
A paid Omega Web Pro licence is a separate commercial transaction. By proceeding through the checkout flow after being given reasonable access to the material purchase terms, submitting payment and using the resulting paid licence, download or customer account, you agree to the provisions governing the paid product and licence, subject always to mandatory law.
If you use the service for a company, organisation, partnership, trust, client or other entity, you represent that you have authority to act for that entity and, where applicable, bind it to these Terms.
If you do not agree to the applicable Terms, you must not use the relevant service or proceed with the purchase.
2. Changes to these Terms
Alpha & Omega Limited may amend these Terms when reasonably necessary to reflect changes to law, security, payment systems, technology, product functionality or business operations.
The current version will be published on this page with an updated “Last Updated” date.
Material changes will not be applied retrospectively to remove an accrued paid entitlement where doing so would be unlawful or unfair.
Additional notice or consent will be provided where required by applicable law.
3. Privacy and electronic communications
Use of Omega Web Pro is also governed by the Privacy Policy .
Personal information may be processed where reasonably necessary for checkout, payment fulfilment, fraud prevention, account creation, authentication, licence administration, support, security, communications and legal compliance.
Where personal information is disclosed outside New Zealand, Alpha & Omega Limited will handle that disclosure in accordance with applicable New Zealand cross-border privacy requirements.
Transactional messages may include receipts, purchase confirmations, account-setup messages, password-reset messages, licence notices, security notices and support communications.
Commercial electronic marketing messages will be handled in accordance with applicable consent, sender-identification and unsubscribe requirements.
4. Licence to use the Site
Subject to these Terms, Alpha & Omega Limited grants you a limited, non-exclusive, non-transferable and revocable permission to access and use the public Site and permitted customer functions for their intended purposes.
This permission does not transfer ownership of Omega Web Pro, its source code, private APIs, engines, internal generation logic, licence system, cryptographic systems, protected metadata, proprietary templates, trade marks or other platform technology.
5. Unacceptable conduct
You must not use the Site or service in a way that is unlawful, fraudulent, misleading, abusive, harmful or inconsistent with the Acceptable Use Policy .
Without limitation, you must not:
- breach another person's intellectual property, privacy, confidentiality or other legal rights;
- upload malware, malicious scripts or content designed to damage or compromise systems;
- attempt unauthorised access to accounts, servers, files, APIs or administrative functions;
- interfere with service operation, security controls, rate limits or availability;
- falsify an order, payment, account, licence, Website ID, domain, export token or signed project record;
- alter protected project metadata or signatures to defeat the one-domain licence model;
- scrape, harvest or automate access in a manner that materially harms the service or violates applicable law;
- use the service to facilitate unlawful, deceptive or infringing activity.
6. Competitors and competitive misuse
Public informational pages may be viewed in the ordinary way.
However, to the maximum extent permitted by law, a competitor or person acting for a competitor must not use Builder, protected exports, private customer functions, proprietary engines, protected metadata, licence or security mechanisms, or non-public platform material for the purpose of reverse engineering, cloning, reproducing or developing a competing website-generation or licensing platform.
This clause does not restrict conduct that applicable law expressly permits and does not prohibit ordinary independent competitive research based solely upon lawfully available public information.
7. Information and website disclaimer
Public information on the Site is provided in good faith for general information about Omega Web Pro.
While reasonable efforts may be made to keep information accurate and current, the Site may contain errors, omissions or information affected by later product, technical or legal changes.
Nothing on the Site is legal, accounting, tax, financial, medical, engineering or other professional advice.
Customers remain responsible for obtaining appropriate professional advice for their own circumstances.
8. Copyright, Intellectual Property and Ownership
8.1 Omega Web Pro copyright and proprietary technology
Omega Web Pro, OmegaWebPro.com, Builder, the Omega engines, generation systems, software architecture, source code, server-side code, private APIs, algorithms, workflows, security systems, licence systems, cryptographic systems, signed project records, portable-project technology, protected metadata, Website ID systems, Licence ID systems, proprietary templates, interface designs, documentation, graphics, branding and other proprietary technology are owned by or licensed to Alpha & Omega Limited.
Except for rights expressly granted under these Terms, all copyright, intellectual-property rights and other proprietary rights in Omega Web Pro and its proprietary components are reserved by Alpha & Omega Limited.
Purchase of an Omega Web Pro Lifetime Single Website Domain Licence does not transfer ownership of the Omega Web Pro platform, Builder, engines, source code, licensing technology, cryptographic technology, protected metadata or other proprietary Omega technology to the customer.
8.2 Generated websites are licensed for one permanent domain
A website generated by Omega Web Pro is supplied under the customer's Lifetime Single Website Domain Licence for deployment and operation on the single permanently licensed domain identified by that licence.
Payment of the licence price grants the customer the rights expressly described in these Terms. It does not constitute a sale or assignment of Alpha & Omega Limited's underlying copyright, proprietary generation technology, protected Omega components or intellectual property.
The customer receives a continuing right, subject to these Terms and applicable law, to use, operate, maintain, update and regenerate the licensed website for its permanently assigned domain.
8.3 Omega-generated websites may not be transferred to another website builder
To the maximum extent permitted by applicable law, an Omega Web Pro generated website, its Omega portable project, protected project specification, signed project identity or other proprietary Omega project data must not be imported into, converted for, incorporated into, or used as the project source for another commercial or competing website-builder, AI website-generator, template-generation platform or substantially similar website-generation system.
The editable Omega portable-project data is intended to be reopened and regenerated through the official Omega Web Pro Builder at: OmegaWebPro.com.
This restriction protects Alpha & Omega Limited's proprietary generation architecture, project format, licensing system, protected metadata and other intellectual property.
8.4 Permitted customer modifications
The customer may modify the ordinary deployable website files where reasonably necessary to operate and maintain the licensed website on its permanently licensed domain.
Permitted modifications may include, subject to these Terms and third-party rights:
- editing the customer's text and website content;
- replacing customer-owned images and media;
- updating contact information;
- updating products, services, prices and business information;
- making ordinary HTML, CSS and JavaScript changes to the deployable Pure HTML website;
- making ordinary permitted WordPress content, theme or configuration changes to the generated WordPress website; and
- maintaining and operating the website on the permanently licensed domain.
These permitted operational modifications do not grant permission to remove, alter, falsify or circumvent protected Omega licensing information, signed project records, Licence IDs, Website IDs, cryptographic signatures, protected metadata or other proprietary Omega security mechanisms.
8.5 Prohibited modification, extraction and circumvention
Except where expressly permitted by these Terms or required by applicable law, the customer must not:
- remove, falsify, replace or alter the permanent Omega Licence ID;
- remove, falsify, replace or alter the permanent Omega Website ID;
- change or circumvent the permanently licensed domain;
- remove, forge or manipulate an Omega cryptographic signature;
- alter protected Omega portable-project metadata for the purpose of defeating or avoiding licence restrictions;
- circumvent authentication, licence validation, export validation or domain-locking systems;
- extract proprietary Omega Builder logic, generation logic, private APIs or protected server-side technology;
- reverse engineer protected Omega technology except to the extent such activity cannot lawfully be prohibited;
- create an unauthorised derivative website-builder, generator, template system or competing software product from proprietary Omega technology; or
- remove or alter copyright, proprietary or licence notices where doing so is intended to conceal ownership, circumvent licensing or facilitate unauthorised distribution.
8.6 No resale of the Omega product, licence or generated package
Unless Alpha & Omega Limited gives prior written permission, the customer must not sell, resell, sublicense, rent, lease, distribute, publish, commercially redistribute or otherwise supply copies of an Omega Web Pro generated website package, Omega portable project, protected template, licensed ZIP or licence as a standalone digital product, website template, website-builder product, downloadable website package or competing generation product.
The customer must not purchase one Omega Web Pro licence and use the generated files, project structure or protected Omega components to manufacture or distribute websites for multiple unrelated domains.
Each different website domain requiring an Omega Web Pro generated website requires its own valid Lifetime Single Website Domain Licence.
8.7 Use for the customer's own business or authorised website
The licence permits the customer to deploy and operate the generated website for the business, organisation, project or other lawful purpose associated with the permanently licensed domain.
Nothing prevents a customer from selling products, services, memberships, bookings or other lawful goods and services through the licensed website.
The restriction is against resale, duplication or redistribution of the Omega-generated website package, licence, protected project or proprietary Omega technology itself, not against ordinary commercial activity conducted through the customer's licensed website.
8.8 Website developers and agencies acting for a customer
A customer may allow an employee, contractor, web developer or professional service provider to work on the customer's deployed website on the customer's behalf, provided that person acts solely for the licensed customer and remains subject to the applicable restrictions in these Terms.
Giving a developer access to maintain the customer's website does not transfer the Omega licence to that developer and does not authorise the developer to copy, resell, redistribute or reuse the website package or protected Omega components for another customer or domain.
8.9 No template harvesting or multi-domain duplication
An Omega-generated website must not be copied, repurposed or used as a master template for generating or supplying substantially the same licensed Omega website to multiple unrelated domains without purchasing the required separate Omega Web Pro licences.
A customer must not extract layouts, protected project structures or proprietary Omega components from a licensed website for the purpose of establishing a competing template library, website-builder library, AI generation service or commercial website-generation product.
8.10 Customer-owned content
The restrictions in this section do not transfer ownership of the customer's own pre-existing intellectual property to Alpha & Omega Limited.
The customer continues to own, or retain its existing rights in, customer-supplied logos, photographs, trade marks, written content, product information, business information and other material that the customer owned or was lawfully entitled to use before supplying it to Omega Web Pro.
8.11 Third-party intellectual property
WordPress, open-source software, fonts, libraries, plugins, stock materials and other third-party components remain subject to their respective copyright owners' licences and terms.
Nothing in an Omega Web Pro licence overrides, restricts or expands rights granted by an applicable third-party or open-source licence.
8.12 Copyright protection and enforcement
Unauthorised copying, redistribution, resale, sublicensing, circumvention or commercial exploitation of protected Omega Web Pro material may constitute both a breach of these Terms and an infringement of applicable intellectual-property rights.
Alpha & Omega Limited reserves all rights and remedies available under applicable copyright, contract and intellectual-property law.
Nothing in these Terms restricts any use, copying, adaptation, interoperability activity, security research, backup activity or other conduct that applicable law expressly provides cannot lawfully be prohibited by contract.
9. Customer and user content
You retain ownership of content you lawfully provide, subject to third-party rights.
You warrant that you have the rights, licences and permissions reasonably necessary for Omega to process that content for the requested service.
You grant Alpha & Omega Limited a limited, non-exclusive licence to host, copy, process, transform and use supplied content only as reasonably necessary to:
- operate Builder;
- create website previews;
- generate and export your website;
- restore licensed projects;
- provide account and support functions;
- maintain platform and account security;
- investigate suspected misuse; and
- comply with applicable law.
This operational licence does not transfer ownership of your business content to Alpha & Omega Limited.
It lasts only for as long as reasonably necessary for the stated purposes, subject to lawful backups, licence records, transaction evidence, security records and statutory retention obligations.
10. Third-party websites and services
The Site or generated websites may link to or integrate with third-party websites and services.
Third-party services are governed by their own terms, privacy policies, prices, technical requirements and availability.
Alpha & Omega Limited is not responsible for the independent acts, omissions, content, security, outages, price changes or policies of third parties, except to the extent mandatory law provides otherwise.
11. The Omega Web Pro service
Omega Web Pro is an AI-assisted website specification, generation, validation, preview and licensed-export platform.
The service may include:
- structured website planning;
- AI-assisted content and configuration;
- Omega-controlled generation logic;
- responsive website generation;
- image processing;
- SEO and structured-data generation;
- accessibility-readiness features;
- performance-oriented generation;
- security-oriented generation;
- responsive preview;
- Pure HTML output;
- WordPress output; and
- protected downloadable website packages.
Generation and preview may be available before purchase. Protected licensed export requires a valid paid licence unless Omega expressly states otherwise.
12. NZ$999 Lifetime Single Website Domain Licence
The standard commercial licence is the Omega Web Pro Lifetime Single Website Domain Licence , currently priced at NZ$999 as a one-time payment, unless another price, tax treatment, discount, promotion or written arrangement is expressly presented at the time of purchase.
Each licence covers one permanently assigned normalized website domain and, subject to these Terms, includes:
- Pure HTML generation for the licensed domain;
- WordPress generation for the licensed domain;
- unlimited future generations, redesigns and rebuilds for that same licensed domain, subject to reasonable technical, security, fair-use and acceptable-use controls;
- protected licensed website ZIP export;
- customer account access linked to confirmed purchased licences;
- supported licensed ZIP upload and portable-project restoration; and
- future same-domain generation without purchasing that same domain licence again.
For these Terms, “Lifetime” means the continuing paid licence entitlement for the licensed domain for the operational life of the Omega Web Pro service, subject to these Terms and mandatory law.
“Lifetime” does not mean that every interface, AI model, third-party provider, technology, optional feature or generation method must remain unchanged or available forever.
Alpha & Omega Limited may update or replace the technology used to provide substantially equivalent or improved functionality.
13. Permanent licensed domain and protected licence identity
The domain assigned when the licence is purchased becomes the permanent domain identity for that licence.
Omega may normalize protocol, path, case where irrelevant
and a leading www. so ordinary URL variations
do not create separate licence identities.

Customers may update supported personal account information but cannot alter the permanent Licence ID, Website ID or licensed domain through My Account, exported metadata, browser requests, API manipulation or any other method.
14. Pure HTML and WordPress output
The same validly licensed domain may be generated as Pure HTML or WordPress in separate generations.
The licence includes rights to both supported output types for that same licensed domain.
A particular generation produces the platform selected for that generation.
Pure HTML output may contain HTML, CSS, JavaScript, images and associated assets.
WordPress output may contain WordPress-specific themes, blocks, content, configuration or supporting files according to the selected generation mode.
15. Purchase, payment and contract formation
Purchases are completed through the checkout flow presented by Omega Web Pro.
Payment may be processed by Stripe or another payment provider expressly identified at checkout.
Starting checkout alone does not create a paid licence. Payment must be successfully confirmed and accepted by Omega's server-side fulfilment process.
After successful payment confirmation, Omega may create:
- the paid order;
- the permanent Licence ID;
- the Website ID;
- the permanent licensed-domain relationship;
- the customer-account association; and
- the protected export authorisation.
The customer is responsible for providing an accurate purchaser email address.
Prices, taxes and other mandatory charges will be handled as displayed at checkout and as required by applicable law.
16. Customer accounts
Omega Web Pro does not provide open public customer registration for paid licence accounts.
Customer access is created from a confirmed paid purchase or another purchase-authorised process approved by Omega.
For a first purchase, Omega may send a secure, time-limited, one-time setup link to the purchaser email address so the customer can create a password.
A customer who already has an account may have additional purchased licences associated with the same account.
Accordingly, one customer account may hold multiple separately purchased website licences.
Each separately licensed website remains permanently associated with its own domain, Licence ID and Website ID.
Supported editable profile information may include:
- customer name;
- company or organisation name;
- phone number;
- postal or contact address;
- password; and
- where supported following appropriate verification, login email address.
Changing personal profile information does not alter the permanent licence identity, Website ID or licensed domain.
You are responsible for keeping account credentials confidential and for notifying support promptly if you reasonably suspect unauthorised access.
17. Protected licensed website ZIP export
A valid paid licence authorises protected export for the relevant licensed project and domain.
Omega may verify the following before delivery:
- order;
- payment status;
- licence;
- project;
- customer account;
- permanent licensed domain;
- Website ID;
- download or authorisation token; and
- other entitlement and integrity data.
The licensed ZIP may contain:
- deployable website files;
- portable project or website specification data; and
- signed Omega metadata linking the project to the customer account, Licence ID, Website ID and permanent licensed domain.
You should securely retain the latest licensed ZIP and backups of deployed websites.
Omega does not promise indefinite online storage of every historical generation or downloaded ZIP.
18. Lifetime same-domain re-editing and regeneration
A customer with a valid licence may use supported My Account functions to upload a licensed Omega Web Pro ZIP for future editing and regeneration.
Customer Account → Licence ID → Website ID → Permanent Licensed Domain → Signed Omega Project
Where validation succeeds, supported project data may be restored into Builder.
No additional NZ$999 licence payment is required merely because the same validly licensed domain is edited, redesigned or regenerated.
The customer may generate the same licensed website again as Pure HTML or WordPress.
If the customer changes the intended website to a different domain, a separate licence is required for that different domain.
19. Temporary projects, retention and backups
Builder working projects, previews, checkout-pending projects, generated workspaces and temporary exports may be automatically removed after configured retention periods.
Permanent commercial licence records may remain after temporary generation files are removed where reasonably necessary to administer the lifetime licence, prove transactions, maintain security and comply with law.
Customers are responsible for retaining their licensed ZIP files and backups required for their own deployment and recovery.
20. Domain registration, hosting, DNS and email are not included
Domain name
You arrange, own or control and renew the licensed domain through your chosen domain registrar.
Web hosting
You obtain and maintain compatible hosting and deploy the generated website to that environment.
Email & external services
Business email, premium plugins, paid APIs and other external subscriptions remain separate unless expressly included.
The licence price is therefore for the Omega Web Pro website-generation and lifetime single-domain licence , not for ownership of the domain registration itself or the customer's external hosting account.
21. Customer responsibilities
You are responsible for:
- the accuracy and legality of information supplied to Builder;
- having rights to logos, images, trade marks, text, datasets and other supplied materials;
- reviewing generated output before publication;
- checking names, prices, contact information, claims and regulated information;
- testing forms, links, navigation, ecommerce functions and integrations after deployment;
- meeting laws, accessibility obligations, industry requirements and professional standards applicable to your deployed website;
- maintaining appropriate privacy notices, cookie or tracking disclosures where required for technologies you choose to deploy;
- maintaining backups;
- maintaining hosting;
- maintaining domain registration and DNS;
- maintaining SSL/TLS where required;
- maintaining business email; and
- maintaining necessary third-party accounts and subscriptions.
22. AI-assisted planning and generated content
Omega Web Pro uses AI-assisted functionality as part of website planning and generation.
AI-assisted systems can produce inaccurate, incomplete, outdated, biased or unsuitable information.
Omega may constrain, process or validate AI-assisted output through controlled generation systems, but cannot guarantee the truth, legality or suitability of every generated statement.
You must review factual claims and legal, medical, financial, technical, regulated, safety-critical or other high-stakes content before publication.
You should obtain qualified professional advice where appropriate.
23. New Zealand consumer and fair-trading rights
23.1 Consumers
Nothing in these Terms excludes, restricts or limits rights or remedies under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other New Zealand legislation where those rights or remedies cannot lawfully be excluded.
Where the Consumer Guarantees Act applies to services provided to you, statutory guarantees may include that services are carried out with reasonable care and skill, are reasonably fit for a particular purpose made known in the circumstances covered by the Act, and are completed within a reasonable time where no time is fixed.
Omega will not represent that a consumer has no statutory remedy where one exists.
23.2 Customers acquiring in trade
If you acquire Omega Web Pro in trade for business purposes, and all legal requirements for contracting out are satisfied, the parties agree that the Consumer Guarantees Act 1993 will not apply to the transaction to the extent legally permitted.
That agreement applies only where:
- the agreement is in writing;
- the relevant services are supplied and acquired in trade;
- all parties to the agreement are in trade;
- the parties agree to contract out; and
- it is fair and reasonable that the parties are bound by that provision.
To the extent legally permitted for parties in trade, the parties also agree to contract out of those provisions of the Fair Trading Act 1986 for which contracting out is expressly permitted, but only where all statutory requirements are satisfied and it is fair and reasonable to do so.
23.3 Unfair terms and misleading conduct
Nothing in these Terms authorises misleading or deceptive conduct, unconscionable conduct or other conduct prohibited by applicable law.
A provision of these Terms will not be applied or enforced to the extent a court or competent authority determines that doing so is prohibited under applicable unfair-contract-term or other mandatory law.
24. International customers and mandatory local law
Omega Web Pro is operated from New Zealand but may be accessible and purchased internationally.
These Terms are intended to operate together with mandatory laws that apply to an international customer.
A New Zealand governing-law clause does not remove mandatory consumer protections that the law applicable to a particular international consumer says cannot lawfully be waived.
24.1 European Union and European Economic Area
Where European Union or European Economic Area consumer law applies, mandatory pre-contract information requirements, digital-content or digital-service conformity rights, remedies and applicable distance-contract withdrawal rights remain available to the extent provided by applicable law.
Where immediate performance or supply of digital content or services can lawfully affect a statutory withdrawal right, Omega will rely on that consequence only where the legally required information, express consent and acknowledgement have been obtained.
24.2 United Kingdom
Where United Kingdom consumer law applies, mandatory rights concerning services, digital content and distance contracts remain preserved.
Any statutory cancellation consequence arising from immediate digital supply applies only where the legal requirements concerning information, consent and acknowledgement have been satisfied.
24.3 Australia
Where the Australian Consumer Law applies, non-excludable consumer guarantees and remedies remain in force.
These Terms do not purport to remove those rights merely because Alpha & Omega Limited is based in New Zealand.
24.4 Other countries and regions
Equivalent mandatory local rights concerning online contracts, digital services, privacy, refunds, unfair terms, consumer protection, jurisdiction or dispute rights remain applicable where the relevant law requires them.
25. Refunds, cancellations and payment disputes
Nothing in this section limits a statutory right to a refund, repair, re-performance, price reduction, cancellation, withdrawal or another remedy.
Omega does not apply a blanket “no refunds” rule where mandatory law provides a remedy.
A change of mind does not automatically create a refund right under New Zealand law. However, customers in some jurisdictions may have statutory cancellation or withdrawal rights.
If there is a problem with a licence, account, generation or export, contact support@omegawebpro.com promptly so the matter can be investigated.
Fraudulent or knowingly false chargebacks may result in proportionate account or licence review.
Nothing in these Terms penalises a customer for legitimately exercising rights available under applicable law or through a payment provider.
26. Warranties and disclaimers
Except for express promises in these Terms and warranties or guarantees that cannot lawfully be excluded, Omega Web Pro is provided on an “as available” basis.
Alpha & Omega Limited does not warrant:
- uninterrupted availability;
- that every generated website will be entirely error-free;
- that every third-party service will remain available;
- a particular search-engine ranking;
- search-engine indexing;
- sales or revenue;
- a particular number of leads;
- a particular level of website traffic;
- a particular conversion rate;
- a particular deployed Lighthouse or Core Web Vitals score; or
- automatic legal compliance of a customer's deployed website without appropriate customer review.
This clause does not exclude any statutory guarantee or warranty that applicable law does not permit Alpha & Omega Limited to exclude.
27. Limitation of liability
27.1 Mandatory rights first
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
27.2 Consumers
For consumers, all non-excludable statutory guarantees, remedies and protections remain in force.
Any limitation in these Terms operates only to the extent legally permitted.
27.3 Customers acquiring in trade
To the maximum extent permitted by law for a customer acquiring the service in trade, Alpha & Omega Limited is not liable for indirect, consequential, exemplary or special loss, or loss of profit, revenue, goodwill, opportunity, anticipated savings or data, where such exclusion is legally permitted.
To that same extent, Alpha & Omega Limited is not responsible for loss caused by:
- customer-supplied content;
- customer configuration;
- external hosting or deployment environments;
- third-party services;
- domain registrar or DNS failures;
- unauthorised modifications;
- malware introduced outside Omega's systems; or
- circumstances outside Alpha & Omega Limited's reasonable control.
For business customers only, and to the maximum extent legally permitted, aggregate contractual liability arising from a particular paid licence is limited to the amount actually paid to Alpha & Omega Limited for that affected licence.
This cap does not apply to fraud, wilful misconduct or liability that applicable law does not permit to be capped.
28. Indemnity for business customers
If you acquire Omega Web Pro in trade, you indemnify Alpha & Omega Limited against third-party claims and reasonable losses arising from:
- unlawful customer content;
- infringement of third-party rights by material supplied by you; or
- deliberate unlawful misuse of the service.
This indemnity does not apply to the extent a claim or loss was caused by Alpha & Omega Limited's own breach, negligence, wilful misconduct or other conduct for which liability cannot lawfully be excluded.
This indemnity does not apply to a consumer to the extent it would be unlawful or unfair.
29. Security and licence integrity
Omega uses security controls intended to protect accounts, payment fulfilment, licence records, download authorisation and signed portable projects.
No online system can be guaranteed absolutely secure.
You must not defeat or attempt to defeat:
- authentication;
- cryptographic signatures;
- download authorisation;
- account ownership checks;
- domain locking;
- Licence ID or Website ID integrity;
- rate limits; or
- other platform security controls.
If Omega reasonably believes an account, licence, project or token has been compromised, it may require re-authentication, invalidate temporary tokens, suspend affected functions or take other proportionate protective action.
30. Discontinuance, suspension and service changes
Alpha & Omega Limited may maintain, update, improve, replace or discontinue individual features where reasonably necessary for:
- security;
- legal compliance;
- technology changes;
- provider changes;
- performance;
- abuse prevention; or
- product development.
Access may be suspended where reasonably necessary because of fraud, security risk, unlawful conduct, serious or repeated breach, abuse of infrastructure, payment reversal, infringement complaints or legal requirements.
Where reasonably practicable and legally appropriate, notice and an opportunity to remedy will be provided before permanent action, except where immediate action is reasonably necessary.
Nothing in this clause permits Alpha & Omega Limited to avoid a mandatory consumer remedy or unlawfully remove an accrued paid entitlement.
31. Complaints and dispute resolution
If a dispute arises, the complaining party should first provide written notice describing:
- the issue;
- the relevant facts;
- relevant order or licence details where applicable; and
- the outcome sought.
The parties should then attempt in good faith to resolve the dispute directly.
This informal process does not prevent either party from seeking urgent interlocutory or injunctive relief where reasonably necessary.
It also does not prevent a consumer from exercising a non-excludable right to use a court, Disputes Tribunal, regulator, statutory complaints process or legitimate payment-provider remedy.
If the dispute is not resolved informally, either party may use an appropriate court or tribunal with jurisdiction.
32. General contract terms
32.1 Entire agreement
These Terms, incorporated policies, applicable checkout information and any written order-specific terms form the agreement relating to the relevant use or purchase, subject to representations and rights that mandatory law says cannot be excluded.
32.2 Order of precedence
Specific written order terms prevail over these Terms only to the extent of an express conflict.
Mandatory law prevails over both.
32.3 Assignment
You may not transfer a licence to another domain in a way that defeats permanent domain assignment.
Alpha & Omega Limited may assign its rights and obligations as part of a genuine business restructure, merger, sale or succession where lawful and without unlawfully reducing customer rights.
32.4 No waiver
A failure to enforce a provision immediately does not waive the right to enforce it later.
32.5 Severability
If a provision is invalid, unlawful or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions continue where legally possible.
32.6 No partnership or agency
These Terms do not create a partnership, joint venture, employment relationship or agency between the customer and Alpha & Omega Limited.
32.7 Survival
Provisions concerning intellectual property, protected licence identity, payment, security, liability, dispute resolution and provisions that by their nature should survive continue after termination where appropriate.
33. Governing law and jurisdiction
These Terms are governed by the laws of New Zealand.
Subject to mandatory rights that cannot lawfully be displaced, the parties submit to the jurisdiction of the New Zealand courts and tribunals having jurisdiction over the dispute.
For international consumers, this governing-law clause does not remove mandatory protections or forum rights that applicable local consumer law says cannot lawfully be waived.

35. Customer dashboard, checkout records, Website Editor and lifetime project controls
The following provisions supplement, and do not replace or reduce, sections 1–34 above. All existing Terms remain in force.
35.1 My Account dashboard
After a qualifying paid purchase, Omega may create or associate a private customer account. My Account may display customer profile information, Customer Account ID, purchased lifetime domain licences, Licence IDs, Website IDs, generation counts, last-used platform and generation timestamps, Pending Checkout orders, Purchase History, licensed ZIP re-editing controls, Website Builder links, Website Editor links and account-security controls. Dashboard presentation may change as the service evolves without changing a permanent paid licence right.
35.2 Account credentials and authorised access
The customer must keep login credentials confidential, use accurate account information, maintain control of the login email address and promptly report suspected unauthorised access. The customer is responsible for activity carried out through its account to the extent permitted by applicable law. Omega may require re-authentication, email verification, password reset or other reasonable security checks before allowing sensitive account actions.
35.3 Permanent commercial records
Customer Account ID, paid Order ID, Licence ID, Website ID, permanently licensed normalized domain, payment status and ownership relationship are commercial, security and licence-integrity records. Profile details and login email may be changeable through authorised workflows, but the permanent licensed domain and licence ownership relationship cannot be changed through ordinary My Account controls. A different domain requires its own licence unless Omega expressly agrees otherwise in writing or mandatory law requires a remedy.
35.4 Pending Checkout
Pending Checkout represents an unpaid licence order for which secure checkout was started. Where available, a customer may resume an existing open Stripe Checkout Session using Proceed to Checkout, or remove an abandoned unpaid pending order using Delete Pending Checkout. Deletion of a pending order may also attempt to expire the associated Stripe Checkout Session. Pending Checkout controls cannot delete or reverse a completed payment, paid Purchase History record, issued licence, Website ID or permanent licensed domain.
35.5 Purchase History
Purchase History is intended to show original paid lifetime-domain licence transactions linked to the authenticated customer account. Same-domain lifetime regenerations, re-edits and re-downloads are not new NZ$999 purchases and need not create new purchase rows. Stripe receipts or invoices relate to the underlying payment transaction and may be governed additionally by Stripe's terms and systems.
35.6 Lifetime re-editing paths
A licensed customer may use supported lifetime same-domain workflows, including Builder regeneration and the Website Editor, subject to authentication, licence validation, service availability, security controls and these Terms. Builder regeneration is intended for supported specification, architecture, design, content and platform changes. Website Editor is intended for supported direct source-file changes. These workflows do not authorise transfer of the licensed website to another domain.
35.7 Licensed ZIP restore and validation
When a customer uploads a previously downloaded Omega licensed ZIP for re-editing, Omega may verify account ownership, Licence ID, Website ID, normalized licensed domain, project metadata and Omega cryptographic/project signature. A ZIP that is corrupted, materially altered outside supported boundaries, unsigned, mismatched to the account or domain, or otherwise fails validation may be refused. Temporary restored workspaces are not permanent backup storage.
35.8 Website Editor access
The Website Editor is a private paid-customer feature for an authenticated licensed Website ID. Access may be denied when authentication, ownership, licence status, project integrity or security checks fail. The Editor may expose supported project files, Undo, Redo, Find, Replace, live preview, validation, save controls, version history, whole-project validation and updated licensed ZIP generation.
35.9 Live preview and PHP isolation
Omega provides separate preview workflows for Builder-generated output and Website Editor changes. Preview is a development aid, not a guarantee that every production hosting environment will behave identically. For security, customer-edited PHP or other server-executable code may be prevented from executing inside the Editor preview. Production PHP behavior must be tested only in an appropriately secured compatible environment.
35.10 Live validation and blocking controls
Website Editor changes may be checked across Website Specification, Brief Normalizer, AI Planning, Plan Validation, Site Architecture, Content Conversion, Design System, Image Engine, SEO + Schema, Accessibility, Forms + Backend, Deployment, Quality / Metrics and Final Validation responsibilities. Validation may inspect HTML, CSS, JavaScript, JSON/JSON-LD, XML, unsafe constructs, malformed data, canonical-domain rules and project integrity. A blocking issue may prevent changed Preview, Save or updated ZIP generation until corrected. Server-side validation remains authoritative even where browser-side validation is also provided.
35.11 Canonical and domain protection
The licensed root/canonical host must remain the permanently licensed normalized domain. Subject to validation and these Terms, customers may rename or reorganise internal pages and paths, for example changing an internal terms filename, provided references, navigation, canonicals, sitemap/schema and other affected links are updated consistently and the root licensed domain is not changed or circumvented.
35.12 Version history and restoration
Where the Editor provides version history, Omega may retain accepted saved revisions for operational recovery. Version history is not a substitute for customer backups and may be subject to technical retention limits. Restoring a version does not change the permanent licence identity.
35.13 Customer code changes
The customer remains responsible for reviewing changes made in Website Editor. Editing source code can introduce defects, accessibility regressions, security vulnerabilities, privacy issues, broken links, invalid structured data, performance regressions or third-party licensing problems. Omega validation reduces certain classes of error but does not constitute legal, security, accessibility, SEO or professional certification.
35.14 Account and editor suspension
Omega may temporarily restrict checkout, account, re-editing, Editor, generation or download functionality where reasonably necessary to investigate fraud, abuse, credential compromise, security risk, licence circumvention, unlawful activity, service integrity or a material breach of these Terms, subject to mandatory law and reasonable restoration where the concern is resolved.
36. Electronic contracting, records and notices
The parties agree that, to the extent permitted by law, contracts, acknowledgements, notices, receipts, licence records, account-verification steps and other information may be created, accepted, provided and retained electronically. New Zealand's Contract and Commercial Law Act 2017 recognises circumstances in which legal requirements may be met electronically. Checkout acceptance records may include timestamps, versions of legal documents accepted, Order ID, account/licence references, technical security records and the required checkbox acknowledgements.
36.1 Pre-checkout acceptance
Required checkout checkboxes form part of the purchase record. A required checkbox is not intended to waive any non-excludable statutory right. Optional marketing consent is separate from purchase acceptance and is not a condition of buying or using a licence.
37. Account data, privacy and security
Personal information processed through My Account, checkout, support, licensed ZIP restore and Website Editor is governed by the Privacy Policy and applicable privacy law. Customers must not place unlawful personal information, secrets or third-party confidential material into Builder or Editor fields unless they have authority and an appropriate legal basis to do so.
38. International mandatory rights and territorial compliance
Omega is operated from New Zealand. These Terms are governed as stated in section 33, but nothing in these Terms excludes mandatory consumer, privacy, electronic-commerce or other rights that applicable law does not permit the parties to exclude. International customers remain responsible for laws applying to the websites they build, edit, deploy and operate.
European Union / EEA
Where the EU GDPR applies, processing must have an applicable lawful basis and comply with relevant transparency, purpose limitation, data minimisation, accuracy, retention, security and accountability obligations. Applicable data-subject rights may include access, rectification, erasure, restriction, portability and objection. Cross-border processing is handled as described in the Privacy Policy and subject to applicable transfer rules.
United Kingdom
Where UK data-protection law applies, applicable UK GDPR and Data Protection Act requirements, individual rights and international-transfer rules remain unaffected by contractual wording. Customers using generated websites are separately responsible for their own controller/processor obligations.
Australia
Where the Australian Consumer Law applies, consumer guarantees and remedies that cannot lawfully be excluded remain available. Where the Australian Privacy Act and Australian Privacy Principles apply, relevant privacy obligations and rights also remain unaffected.
California and other jurisdictions
Where a privacy law such as the California Consumer Privacy Act applies to Omega's processing, applicable statutory rights are respected subject to legal scope, thresholds and exceptions. No clause should be read as creating rights where a law does not apply or removing rights where it does.
